How to strategically use IP?

Intellectual property (IP) on this page refers to the broader concept of a company’s intangible assets, including:

  • Intangible assets protected by a legal framework of intellectual property rights that gives its owner exclusive rights, including. through patents, trademarks, design rights and copyrights; and
  • soft IO” at the disposal of the company, which may not be covered by the formal legal system, but is nevertheless commercially valuable to the company, such as confidential know-how, trade secrets, data, algorithms, etc..

By exploiting these rights and opportunities, companies can protect their differentiation and competitiveness in international markets, develop new business models, accelerate growth and increase profitability.

An IP strategy is a blueprint for achieving a company’s objectives, which brings together guidance on the creation/ownership, protection and use/enforcement of intellectual property (IP) rights in order to make effective decisions to maximise value creation and capture business benefits from the organisation’s technologies, products and services.

Intellectual property tools help companies create, maintain and develop their competitive advantages, whether it’s a strong brand, a unique design or a world-changing technology. Companies with (protected) intellectual property have significantly higher levels of innovation and profitability, stronger international competitiveness and, in general, a longer lifespan.

According to a joint study by the EUIPO and EPO, start-ups with registered intellectual property are 2 to 3 times more likely to raise money, and up to 10x more likely if they have both patents and trademarks. Therefore, a well thought-out IP strategy, protection and enforcement position is crucial for technology-intensive companies, also in Estonia.

Companies that have an effective IP strategy tend to have a strong and functioning innovation culture. If a company is serious about harnessing and protecting the innovative creation of its employees, recognising innovators and giving them the opportunity to contribute to the company’s success, this will have a strong impact on both employee productivity and the company’s added value.

This is why a conscious approach to intellectual property is also one of the key parameters in the Innovation Trail methodology for determining the innovation management capacity of companies.

IP tools for companies

To transform intellectual property from a cost centre to a value centre, it needs to be consciously managed. To manage something, you need to define it and make it measurable. In the Enterprise IP Management Toolbox, we give companies the primary tools they need to do this.

Enterprise IO management tools

In development cooperation negotiations between companies, but also between companies and research institutions, the main source of difficulties is often the treatment of the intellectual property rights that the parties contribute to and create during the project, so that everyone gets what they need and no one feels bad about it.

In putting together a guide to best practice in IP negotiation in development cooperation, we have drawn on the experience and best knowledge of international companies, experts and research institutions. It and the accompanying tools are now freely available in Estonian for our companies.

Development Collaboration IO tools

It is possible to monetise IO by giving it to another party or company to use, either for a fee or for free.
We have compiled and are making available to companies a growing number of best practices and tools that can be accessed via the following link:
